General Estate Planning Information


Welton Law, LLC, is committed to crafting and providing an individualized estate plan, special needs plan, and elder law plan to assist our various clients in these different, and often difficult, stages of life. Let’s face it – oftentimes, these are some of life’s most challenging decisions we’d rather avoid a few more days because we would rather not think about our own death or incapacity, a loved one with special needs requiring care in our absence, or leaving our homes to allow others, whether it’s family or a facility, to care for us in our golden years. Creating an estate plan is not just for the millionaires but for you and me. Crafting an estate plan, while it does take into consideration your assets, there are other considerations such as:

  • Do you have minor children? Do you want leave assets directly to them or to another to control the funds while using it for the benefit of the minors? Who do you want to provide care to, and make decisions for, your children should you pass while they are minors? Do you understand what happens after you’ve passed leaving minor children with and without a Will?
  • Do you have a loved one with special needs? Does he/she receive resource-dependent public benefits? What will happen to certain benefits they receive if proper planning is not done? Do you need to obtain guardianship of an adult with disabilities? If you have guardianship, have you taken proper steps in your estate plan to ensure there is an alternate guardian in your absence?
  • Do you have a loved one that is the incapable of making good decisions when it comes to money? Do they have any addiction that may increase the likelihood of them wasting the money in a short period of time?
  • Have you appointed someone to make medical and financial decisions for you if you are ever unable to act for yourself?
  • Do you have assets that require you consider annual gifting as well as other techniques to minimize the likelihood that your estate will be subject to Federal Estate Tax?
  • Do you have a business? Are there others who can act for you with respect to the business if you are incapable? What will happen to your business or your share thereof upon your death? Does your business have a buy-sell agreement?
  • Are you concerned that you will need care in a skilled nursing facility? Do you have enough assets to private pay for this expense? Have you considered techniques to preserve your assets while still allowing you to qualify for government benefits that will assist with that cost? Have you thought about long term care insurance and if it is right for you?
  • Would you like for your loved ones to be able to avoid the probate/estate administration process? Have you implemented a plan that will ensure that? While a trust may be helpful to some, it is not the answer for all (despite many lawyers encouraging their clients to utilize it).
  • Have there been any major changes since your last estate plan was created, such as:
    • A death in the family;
    • A birth;
    • Disability;
    • Marriage; and/or
    • Divorce?
  • Has it been reviewed by an attorney recently?
