General Estate Administration Information


When a loved one passes away, you may be required to administer the estate at a difficult time when you are grieving and mourning the loss of your loved one.  Welton Law, LLC, assists with the administration of your loved one’s estate with experience and compassion.  The process is often referred to as the probate process or estate administration.  Welton Law, LLC, works with the personal representative of the estate in fulfilling the personal representatives duties and obligations, which may include:

  • Collecting and organizing assets;
  • Preparing deeds of distribution;
  • Noticing creditors;
  • Paying estate debts;
  • Locating beneficiaries;
  • Minimizing estate tax liability;
  • Preparing and filing inheritance tax returns in states where it is required;
  • Valuing, managing and liquidating estate property;
  • Completing and filing county required paperwork; and

Not all estates are required to do a formal estate administration as some states have alternative probate processes.  For example, in South Carolina, some estates qualify for summary administration or small estates collection.  Additionally, for decedent’s that owned property in several states both a domiciliary (state of residence) and ancillary (other states) administration may be required.  Welton Law, LLC, will help you determine the best process to administer your loved one’s estate in an effort to save you time, energy, and money. 

Most estate will not owe estate tax, and only a few states, such as Pennsylvania, impose an inheritance tax.  Inheritance Tax imposes a tax on a beneficiary who inherits or receives money, property, or other assets from a person who has died.  The Federal estate tax levies a tax on the estate of a person who has died and generally allows for a certain amount (value) of assets to transfer without incurring tax, which is known as the Federal estate tax exemption.  The Federal estate tax is often a subject, on which politicians tend to disagree and attempt to change.  It is important to pay attention to this as elected offices change political parties as it may require that additional tax planning techniques be implemented in your estate plan to minimize estate tax.
